9:06 am
this one, it will be a doozy. allison, the two candidates really went after each other. was a heated debate, with the two clashing over everything from libya to medicare. because this was their only matchup before the election, both biden and ryan were under the gun last night to strike hard and fast. >> reporter: from the moment they settled into their seats here, you knew this would be a tough night. vice president joe biden under pressure to help his ticket recover from last week's presidential debate was forceful and aggressive. >> with all due respect, that's a bunch of malarkey. >> reporter: watching on a split screen, it may have hardened partisans on both sides, with biden on the attack, but often seen laughing and interrupting ryan. >> mr. vice president, i know -- >> no -- >> mr. vice president, i know you're under duress to make up for lost ground. i'm mitt romney and i approve this message. a family can make... realizing a nursing home is the only choice. for many middle class families, medicaid is the only way to afford the care. but as a governor, mitt romney raised nursing home fees eight times. and as president, his budget cuts medicaid by one-third and burdens families with the cost of nursing home care. we have a president who won't let that happen.
9:14 am
[ obama ] i'm barack obama and i approved this message. we have a heartwarming story at the ballpark yesterday. the nationals teamed up with the army to reunite a military family. sergeant hector banda has been in afghanistan the last five months while his family is in germany. the army flew the family to d.c. for the game. they had no idea dad was going to show up. >> i was just shocked.
9:15 am
i was happy to see that. the kids were really surprised. >> i'm thankful for them. i'm very thankful for the nationals and i'm thankful for the army letting me come over here and be part of this. it's very exciting. >> sergeant banda says he'll spend the next two weeks sight seeing with his family in d.c. and new york city. during the game last night they showed the family down in the corner there, and that little boy, man, was grabbed on to his father, would not let him go. really was something. >> that would have been it for me. thank you tony. the countdown to the election is on. so it's only fitting after last night's fiesty debate that today's ask allison has to do with the election. so, a viewer writes, i had her name, it is marsha reynolds, can a presidential nominee quit the race before election? if so, what happens? does the v.p. nominee run for election or
9:16 am
does the nominee concede and the current president declared the winner, and has this ever happened before? marsha thanks for writing in. you would not believe how much research we did. it was like a team of people, pat, matt and myself, trying to figure out the answer to this. you would think it would be easier. i think the reason it's not that easy to find is because it's rarely happened. i couldn't find it once as far as the presidential nominee. did find something on the vice presidential nominee back in the '70s. we searched the rnc and dnc web sites and at the end we find the answer in those. just quickly, the dnc in their section one of their bylaws basically it says their responsibilities include filling vacancies in the nomination for office of president and vice president. on the rnc web site in rule number 9 it just speaks about filling vacancies in nominations and basically speaks about going back to the convention process and having

to nominate someone again and starting it all over again. but there's still many questions that remain and because of that, we are turning to a friend. professor lenny steinhorn is on the line from american university uc. i'm calling you in for double duty this week. good morning. >> good morning. how are you? >> i'm doing well, lenny. what an interesting question. the only person i could find caught up in quitting or having to leave the race, of course, was vice presidential candidate, the democratic v.p. candidate in '72. thomas eagleton. to your knowledge has anyone else ever quit and can you tell us more about eagleton? >> i think so many people want to be in those positions, that it's unlikely they want to quit. eagleton was sort of a last minute choice by the nominee
9:18 am
george mcgovern. they didn't do a lot of apparently that morning, mcgovern said let's go with eagleton. then the drip, drip, drip of stories began to come out of all the research that had been done on him that he had had seous psychological issues. he had been psychiatric care, gotten shock therapy. even though he was fine after that, it was too much for the political culture to tolerate. so they took him off the ticket. he resigned from the ticket. senator mcgovern then chose sergeant shriver as his choice. you have to go through the party, though, to get somebody to replace somebody on the ticket. this is the party's nominee. therefore, the party has to approve whoever might replace somebody. >> interesting. now, so the vice presidential candidate, so in this case, looking at the gop, since he's the contender here, if mitt romney said, i'm done, i don't want to run, if wouldn't
9:19 am
automatically be paul ryan, you'd have to go through the process again? >> right. because paul ryan was nominated to be the vice presidential candidate. it's not like succession in the presidency, where the vice president by constitution assumes the presidency. so the party has to nominate somebody. they may nominate paul ryan, and may not convene the convention, but to hold a mini group, let's say the steering committee, executive committee, and be able to do that or seek affirmation from their rank and file. the bottom line in a crisis situation like that, where the unsuspected happens, the party has to move quickly. also because they have to make sure the right names are on the ballot. >> that was my last question. what about the mail absentee or professional ballots, if it's that close, might have the other person's name on it. >> i don't know how the law would judge this. presumably they could say, well, this is the republican ticket. somebody is voting for. on the other happen, they may say, no, if mitt romney is on
9:20 am
there and it's not paul ryan at the top of the ticket, that invalidates that vote. i think these would be legal battles that would probably make the 2000 controversy between gore and bush seem ke a little tempest in the tea pot. >> lenny, tony perkins often brags about how you were his professor at au and all that. i wish you were one my professors. you're fantastic. >> well, thank you. >> thank you for joining us today. >> see you next time. >> see you next time. >> bye-bye. >> there is the answer. interesting. you would think -- but as lenny said, so many people -- if you get to that point, you really want this. >> has to be something unusual that would happen -- >> like eagleton. if you have a question you would like answered, send it to myfoxdc.com, click on the morning tab for a link to ask allison. >> good stuff. imagine opening your mail and finding a check for a half a billion dollars. >> i would say, thank you.
